Terms And Conditions
Terms and Conditions of Anorok
§ 1 General Information
(1) These Terms and Conditions ("T&Cs") apply to all orders placed by consumers at:
Henning Lüke
Averkampstr. 7
D-48151 Münster, Germany
Email: info@anorok.com
("Anorok"), as the operator of the online shop at www.anorok.com (“Online Shop”).
Anorok is not a registered company and is operated by Henning Lüke as a private individual.
(2) All agreements between Anorok and customers in connection with an order are set out in writing in the purchase contract, these T&Cs, and the order confirmation from Anorok. By placing an order, the customer agrees to be bound by the T&Cs applicable at the time of the order. Any terms from the customer that conflict with these T&Cs will not be accepted. The contract text will be stored electronically by Anorok; however, for security reasons, it cannot be accessed after the order is completed. Registered users may view and update their personal information within their account.
(3) The contract language is English. Any German terms used in these T&Cs are provided for convenience and reference only.
§ 2 Offer and Order Process
(1) The products displayed in the Online Shop are offered to individuals or legal entities with full legal capacity. Minors or persons with limited legal capacity may only purchase goods with the consent of their legal guardian.
(2) The presentation of products in the Online Shop does not constitute a legally binding offer but is an invitation to submit an order.
(3) The customer places products in the shopping cart and proceeds through the checkout process. By clicking "Buy" at the end of the order process, the customer makes a legally binding offer to purchase the goods. Any information provided before completing the order can be corrected using the edit functions ("Edit" or "Delete").
(4) An order confirmation will be sent after the order is received. This order confirmation does not constitute acceptance of the offer. The contract becomes legally binding when Anorok either sends a shipping confirmation, requests payment, or explicitly accepts the order.
§ 3 Right of Withdrawal
(1) Right of Withdrawal for Consumers
Consumers have the right to withdraw from the contract within 14 days without giving any reason.
To exercise your right of withdrawal, you must inform us:
Henning Lüke
Averkampstr. 7
D-48151 Münster, Germany
Email: info@anorok.com
by sending a clear declaration (e.g., a letter sent by post or email) stating your decision to withdraw from this contract.
(2) Effects of Withdrawal
If you withdraw from the contract, we will refund all payments received from you, including outbound shipping costs (in the case of a full return), within 14 days from receiving the goods back or proof of their return. The same payment method will be used unless otherwise agreed.
We may withhold reimbursement until we have received the goods or evidence of their return. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
The customer bears the cost of returning the goods from outside the EU, UK, or Switzerland.
§ 4 Prices and Payment
(1) All prices in the Online Shop are inclusive of VAT, but exclusive of shipping costs unless otherwise stated. The prices valid at the time of the order apply. The customer will be informed of the shipping costs during the ordering process.
(2) Anorok accepts the following payment methods:
Credit Card (MasterCard, Visa, American Express)
PayPal
Sofort-Überweisung (Klarna)
§ 5 Delivery and Shipping
(1) Delivery times are estimates. Anorok will dispatch the goods within 2-3 business days after receipt of payment unless otherwise stated.
(2) Deliveries will be sent to the address provided by the customer. In case of partial availability of products, Anorok may make partial deliveries at no additional cost to the customer.
(3) If a delivery cannot be fulfilled due to supplier issues or force majeure, Anorok reserves the right to withdraw from the contract and will notify the customer immediately. Payments already made will be refunded promptly.
§ 6 Retention of Ownership
Goods remain the property of Anorok until full payment is received.
§ 7 Warranty and Liability
(1) Customers are entitled to statutory warranty rights (Gewährleistung) under German law. If goods are defective, the customer may request a repair or replacement. If Anorok is unable to fulfill this, the customer may request a reduction in price or cancellation of the contract.
(2) Anorok is liable for damages only in cases of gross negligence or intentional misconduct. Liability for slight negligence is excluded unless it concerns damage to life, health, or breach of essential contractual obligations (without which the fulfillment of the contract is not possible).
§ 8 Privacy Policy
(1) Personal data provided by the customer will be processed according to the German data protection laws (GDPR). Anorok collects and uses the data provided by the customer to fulfill orders and for related purposes, including shipping and payment processing.
(2) Once the contractual relationship is fulfilled, personal data will be deleted in accordance with statutory retention periods.
A detailed privacy policy can be found at www.anorok.com/policies/privacy.
§ 9 Final Provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers residing outside of Germany, mandatory consumer protection laws in their country of residence may apply.
(2) If any provisions of these T&Cs are invalid, the remaining provisions shall remain valid.
§ 10 Dispute Resolution
We are not obliged or willing to participate in dispute resolution procedures before a consumer arbitration board under the VSBG.
